BRANDWORKSAPP LLC ("Company," "we," "us," or "our"), a Florida limited liability company (Reg. L25000543729) with its principal office at 700 Siena Palm Dr, Suite 303, Celebration, FL 34747, operates the website brandworks.us (the "Site") and provides commercial photography services. This Privacy Policy explains what we collect, why, how we protect it, and your rights under U.S. federal law, Florida law, the California privacy laws (CCPA/CPRA) and the EU/UK GDPR.
1. Information We Collect
1.1 Information you provide. Through our contact form, email, phone or messaging we collect your name, email, phone number (if provided), the service you select and your message. Booking clients also provide billing details, shoot locations and project briefs.
1.2 Information collected automatically. When you visit the Site, our hosting provider and analytics tools may collect your IP address, browser type and version, operating system, device type, pages viewed, time on page, and referring URL. Google Fonts may receive your IP address when loading fonts.
1.3 Cookies and similar technologies. We use a minimal set of cookies described in our Cookie Policy.
1.4 Photographic content. In the course of providing services we create and process photographs, video and AI-assisted imagery that may include people, property, products and premises. See Section 6.
2. How We Use Your Information
We use your information to: respond to inquiries and provide quotes; plan, deliver and invoice photography services; operate, secure and improve the Site; send service and (with consent) marketing communications; and comply with legal, tax and accounting obligations. We do not engage in automated decision-making that produces legal effects, and we do not sell your personal information.
3. Communications & Consent (TCPA)
By submitting the form and ticking the consent boxes, you authorize us to contact you by email and/or phone (call or text) regarding your inquiry, using the details you provide. Message and data rates may apply. Consent to marketing messages is not a condition of purchase. You may opt out of marketing at any time by replying STOP to texts, using the unsubscribe link in emails, or emailing info@brandworksapp.us. We honor U.S. TCPA and CAN-SPAM requirements.
4. Third-Party Services
We rely on the following processors, each under their own terms and privacy policies:

5. Data Sharing & Disclosure
We do not sell, rent or trade your personal information. We disclose data only to: the processors above under data-processing agreements; professional advisors (legal, accounting) under confidentiality; authorities when required by law or to protect rights and safety; and a successor entity in the event of a merger or sale, with notice.
6. Image, Likeness & Releases
Commercial photography may capture identifiable individuals, branded products, interiors and exteriors. Where required, the client is responsible for obtaining model and property releases (see our Terms). We retain delivered work and project files as described below, and we will not publish images a client has designated confidential. Individuals who appear in our work may request that we stop using their likeness in our own marketing by contacting us.
7. Data Retention
Contact submissions: up to 3 years after last contact. Client project records and deliverables: up to 7 years for tax, legal and archival purposes, unless you request earlier deletion where permitted. Server logs: per provider policy (typically 30–90 days).
8. Your Privacy Rights
All users. You may request access to, correction of, a copy of, or deletion of your personal data, and you may withdraw consent at any time. Email info@brandworksapp.us and we will respond within 30 days. We will not discriminate against you for exercising your rights.
9. California Residents (CCPA/CPRA)
In the prior 12 months we may have collected the categories: identifiers (name, email, phone, IP), commercial information (services requested), and internet activity (site usage). We do not sell or "share" personal information as defined by the CPRA, and we do not process sensitive personal information for inferring characteristics. You have the right to know, access, correct, delete, and limit, and to opt out of sale/sharing (not applicable as we do none). Submit requests to info@brandworksapp.us; we will verify your identity before responding.
10. EU/EEA & UK Residents (GDPR)
Our legal bases are: consent (contact and marketing), performance of a contract (delivering services), and legitimate interests (securing and improving the Site). You additionally have the rights to portability, restriction, objection, and to lodge a complaint with your supervisory authority. Transfers to the U.S. rely on appropriate safeguards.
11. Data Security
We use reasonable safeguards including HTTPS/TLS encryption in transit, access controls, and reputable processors. No method of transmission or storage is 100% secure; we cannot guarantee absolute security. In the event of a breach affecting your personal data, we will notify you and any regulators as required by applicable law.
12. Children’s Privacy
The Site is intended for adults and is not directed to children under 16, and we do not knowingly collect their data. Minors who appear in commissioned photography are handled through the commissioning client with appropriate parental/guardian consent and releases.

14. International Transfers
Your data is processed in the United States. By using the Site you understand your data will be transferred to and processed in the U.S., which may have different data-protection laws than your country.
15. Third-Party Links
The Site may link to third-party sites (e.g., Google, Instagram). We are not responsible for their content or privacy practices; review their policies.
16. Changes to This Policy
We may update this Policy; the "Last Updated" date will change and material changes will be highlighted. Continued use after changes constitutes acceptance.
